Acceptance of Conditions

This is an agreement between you and HireGeeks.com. Use of the service provided by HireGeeks.com (the “service”) constitutes acceptance of these terms and conditions. If you do not wish to abide by these terms and conditions, you must stop using the service immediately.

Use of the Service

You agree to use the service and access http://www.hiregeeks.com and related pages (collectively, the “website”) in accordance with all applicable local, state, national, and international laws. Additionally, you agree not to post any content that is unlawful, harmful, threatening, obscene, libelous, or fraudulent. You agree not to post any content with the intent of abusing a flaw in the website's backend software and agree to report any such vulnerabilities to webmaster@hiregeeks.com immediately upon discovery. Finally, you agree not to infringe upon others' rights to use the website under these terms.

Use of the Service by Minors

If you are under 18 years of age, you certify that your parent or legal guardian has agreed to these terms of service on your behalf. Additionally, you certify that you are in compliance with child labor laws and other restrictions placed on minors that could effect the terms of this agreement.

Minors under the age of 13 may not use this service.

Privacy of Information

Any information that you submit while using the service may be recorded, altered, or deleted by HireGeeks.com personnel. Use of the service does not constitute a professional relationship and no guarantee of accuracy or confidentiality of information is made beyond that in the privacy policy.

Dispute Resolution

You agree to abide by any decisions involving your use of the service or the website made by HireGeeks or its mediators in dispute resolution. Alternatively, you may appeal the decision made in dispute resolution to HireGeeks if a mediator resolved the original dispute. In these cases, the outcome of the appeal is final.

You also agree to forfeit your right to rate the other party in a project if HireGeeks or a mediator decide to prohibit rating on that project.

Payment

You agree to promptly pay all HireGeeks fees that may be charged to your account, even in the event of termination of this agreement. You agree to remunerate HireGeeks for any losses incurred while collecting overdue fees.

HireGeeks fees are typically non-refundable, though exceptions may be made on a case-by-case basis by HireGeeks. Tips made to geeks are paid directly and are thus non-refundable. Refunds may be given of project amounts at the discretion of HireGeeks.

Limitation of Liability

Under no circumstances will HireGeeks.com be held responsible for damages resulting from your use of the service or contact between you and a third party (such as a buyer, geek, or mediator) found through use of the service, irrespective of whether HireGeeks has been advised of the possibility of such damages. Additionally, under no circumstances will HireGeeks.com be held liable for any amount for services rendered, unless this limitation is prohibited by law. Under no circumstances will liability exceed $5.00 USD unless prohibited by law.

Content posted by a third party (the “user”) does not reflect the views or affiliations of HireGeeks.com. Under no circumstances may HireGeeks.com be held liable for such content.

No Warranty

There is no warranty for information or work provided to you through the service. Except as otherwise stated by HireGeeks.com, all content provided to you by the website or the service is provided “as is”, without warranty of any kind, either expressed or implied.

Indemnity

You agree to indemnify HireGeeks.com and its agents from any claim related to your use of the service or website. If such a claim arises, HireGeeks.com will provide you with written notification.

Spam and Agents

Unsolicited commercial messages (colloquially “spam”) are prohibited. Additionally, nonhuman agents (colloquially “bots”) are prohibited from accessing the service (but not other parts of the website) unless prior approval to run an agent is granted by HireGeeks. Permission to run a specific agent does not constitute permission to run other agents as well. Web crawlers and other read-only agents used to aid in the searching or categorization of HireGeeks' information are exempt from this clause.

Intellectual Property

You agree not to infringe upon the intellectual property of HireGeeks, including any trademarks, copyrights, or patents that HireGeeks may posses. Use of our intellectual property is permitted only by written approval from HireGeeks.

Authentication

You grant HireGeeks.com the right to treat any person that correctly authenticates as you, using your username and password, as you. You agree to hold HireGeeks.com harmless for any actions performed by an intruder with your authentication information. If you believe your account has been compromised, contact us immediately and we will investigate.

Termination

Either party to this agreement may terminate this agreement at any time, with or without reason. In the event that this agreement is terminated, you must stop using the service immediately.
